Terms of Service

1. Agreement

By accessing or using Fervid (fervidai.com), you agree to be bound by these Terms of Service ("Terms"). If you are using Fervid on behalf of an organisation, you represent that you have authority to bind that organisation. If you do not agree to these Terms, do not use Fervid.

2. The Service

Fervid is a feedback intelligence platform that helps product teams collect, organise, and analyse customer feedback from connected tools (Intercom, Zendesk, Slack, etc.) and CSV uploads. We use AI to surface themes, priorities, and insights from that feedback.

3. Your Account

  • You must provide accurate information when creating your account.
  • You are responsible for maintaining the security of your credentials.
  • You must notify us immediately of any unauthorised account access.
  • One account per person; accounts are non-transferable.

4. Acceptable Use

You agree not to:

  • Upload or import data you do not have the right to use
  • Attempt to reverse-engineer, scrape, or extract data from the platform
  • Use Fervid to store or process sensitive personal data (health records, payment card data, government IDs) beyond what is incidental to customer feedback
  • Resell, sublicense, or white-label Fervid without written permission
  • Violate any applicable law or third-party rights
  • Circumvent usage limits or abuse the free tier

5. Your Data

You retain all ownership rights to the data you upload or import into Fervid ("Your Content"). You grant us a limited licence to store, process, and display Your Content solely to provide the service to you. We do not claim ownership of Your Content and do not use it to train AI models for third parties.

You are responsible for ensuring you have the legal right to import data from connected third-party services (e.g., that your use of Intercom or Zendesk customer data complies with your own privacy policy and applicable law).

6. Plans and Billing

  • Paid plans are billed monthly or annually in advance via Polar.
  • Subscriptions renew automatically unless cancelled before the renewal date.
  • Downgrades take effect at the end of the current billing period.
  • We do not offer refunds for partial months except where required by law.
  • We reserve the right to change pricing with 30 days notice to existing subscribers.

7. Service Availability

We aim for high availability but do not guarantee uninterrupted service. We may perform scheduled maintenance with advance notice. We are not liable for downtime caused by third-party services (Supabase, Vercel, Anthropic, etc.) or events outside our control.

8. Intellectual Property

Fervid, its logo, and all platform software are owned by Fervid AI, Inc. and protected by intellectual property laws. Nothing in these Terms grants you any rights to our trademarks, patents, or proprietary technology.

9. Termination

You may cancel your account at any time from your billing settings. We may suspend or terminate your account if you violate these Terms, with or without notice depending on severity. Upon termination, your data will be deleted within 30 days as described in our Privacy Policy.

10. Disclaimers

Fervid is provided "as is" without warranties of any kind, express or implied. We do not warrant that AI-generated insights are accurate, complete, or suitable for any particular business decision. You should exercise your own judgement when acting on any analysis produced by the platform.

11. Limitation of Liability

To the maximum extent permitted by law, Fervid AI, Inc.'s total liability to you for any claims arising from your use of the service is limited to the fees you paid in the 12 months preceding the claim. We are not liable for indirect, incidental, special, or consequential damages.

12. Governing Law

These Terms are governed by the laws of the State of Delaware, USA. Any disputes will be resolved in the courts of Delaware. If you are a consumer in the EU, mandatory local consumer protection laws in your country may also apply.

13. Changes to These Terms

We may update these Terms. We will notify you by email at least 14 days before material changes take effect. Continued use after the effective date constitutes acceptance.
